Sumário: Regulamento dos Planos de Regularização de Dívidas de Propinas do Instituto Politécnico do Cávado e Ave.
Considerando que a Portaria n.º 197/2020, de 17 de agosto, que regulamenta os planos de regularização de dívidas de propinas, prevê, no seu artigo 5.º, a aprovação de regulamentação adicional por parte das instituições de ensino superior.
Considerando que nos termos conjugados da alínea u) do n.º 2 do artigo 38.º, dos Estatutos do Instituto Politécnico do Cávado e do Ave, aprovados pelo Despacho Normativo n.º 1-A/2019, publicado na 2.ª série do Diário da República n.º 113, de 14 de junho, e da alínea o) do n.º 1 do artigo 92.º do Regime Jurídico das Instituições de Ensino Superior, aprovado pela Lei n.º 62/2007, de 10 de setembro, compete ao Presidente do IPCA aprovar os regulamentos previstos na lei.
Considerando a urgência do procedimento devido ao facto de já se ter iniciado o ano letivo de 2020-2021.
Considerando ainda a necessidade imperiosa de disponibilizar aos estudantes e antigos estudantes mecanismos que permitam a regularização de dívidas de propinas no ano letivo que se iniciou, face à recente legislação, dispensando-se por isso a consulta pública nos termos da alínea a), do n.º 3, do artigo 100.º do Código do Procedimento Administrativo.
Ouvido o Conselho de Gestão, o Conselho de Diretores e a Associação Académica do IPCA, aprovo o Regulamento dos Planos de Regularização de Dívidas de Propinas do IPCA, o qual vai publicado em anexo ao presente Despacho e do qual faz parte integrante.

Regulamento dos Planos de Regularização de Dívidas de Propinas do Instituto Politécnico do Cávado e Ave
Preâmbulo
A Lei n.º 37/2003, de 22 de agosto, alterada pela Lei n.º 68/2017, de 9 de agosto, e pela Lei n.º 75/2019, de 2 de setembro, que aprova as bases de financiamento do ensino superior, prevê no artigo 29.º-A, que as instituições de ensino superior públicas devem ter planos de regularização destinados a estudantes com propinas em atraso. As condições de acesso ao plano de regularização previsto nesse artigo 29.º-A seriam definidas por Portaria do Governo. Posteriormente, a Lei n.º 32/2020, de 12 de agosto, criou um mecanismo extraordinário de regularização de dívidas por não pagamento de propinas, taxas e emolumentos por parte de estudantes que, devido à crise económica e social causada pela pandemia da doença COVID-19, tenham ficado impossibilitados de proceder ao seu pagamento junto das instituições de ensino superior públicas. Esta Lei n.º 32/2020 previa que seria regulamentada por Portaria do Governo. Adicionalmente a Resolução da Assembleia da República n.º 67/2020, de 5 de agosto, recomendou ao Governo a adoção de medidas de apoio aos estudantes internacionais, entre as quais se inclui a garantia de acesso ao mecanismo extraordinário de regularização de dívidas por não pagamento de propinas.
A Portaria n.º 197/2020, de 17 de agosto, veio regulamentar ambas as Leis, definindo os planos de regularização de dívidas de propinas e remetendo para as Instituições de Ensino Superior a definição, através de regulamentação institucional, no âmbito de várias matérias, designadamente a sua aplicabilidade a antigos estudantes e aos estudantes internacionais.
Este regulamento irá permitir a todos os estudantes, bem como a antigos estudantes o acesso a planos para regularização de dívidas de propinas, e com isso combater o abandono escolar.
Neste contexto, o presente regulamento vem dar resposta a essa necessidade de definição dos procedimentos associados aos planos de regularização de dívidas, ajustando-os à realidade do IPCA.
Artigo 1.º
Objeto e norma habilitante
1 - O presente regulamento estabelece as regras aplicáveis aos planos de regularização de dívidas de propinas no Instituto Politécnico do Cávado e Ave (IPCA).
