Portaria n.º 150/2004 de 13 de Fevereiro A luta contra a evasão e fraude internacionais passa também pela adopção de medidas defensivas, tradicionalmente designadas por medidas antiabuso, traduzidas em práticas restritivas no âmbito dos impostos sobre o rendimento e sobre o património, benefícios fiscais e imposto do selo, que têm como alvo operações realizadas com entidades localizadas em países, territórios ou regiões qualificados como 'paraísos fiscais' ou sujeitos a regimes de tributação privilegiada.
Tendo em conta as dificuldades em definir 'paraíso fiscal' ou 'regime fiscal claramente mais favorável', o legislador nacional, na esteira das orientações seguidas por outros ordenamentos jurídico-fiscais, optou, nuns casos, por razões de segurança jurídica, pelo sistema de enumeração casuística e, noutros, por um sistema misto, estando, no entanto, ciente de que tais soluções obrigam a revisões periódicas dos países, territórios ou regiões que figuram na lista.
Assim: Manda o Governo, pelo Secretário de Estado dos Assuntos Fiscais, nos termos do n.º 2 do artigo 3.º do Decreto-Lei n.º 88/94, de 2 de Abril, o seguinte: Para todos os efeitos previstos na lei, designadamente no n.º 3 do artigo 16.º do Código do IRS, no n.º 2 do artigo 59.º e no n.º 3 e na alínea c) do n.º 7 do artigo 60.º do Código do IRC, na alínea b) do artigo 26.º, no n.º 7 do artigo 41.º e no n.º 8 do artigo 42.º do EBF, no n.º 3 do artigo 7.º do Código do Imposto do Selo, no artigo 3.º do Decreto-Lei n.º 88/94, de 2 de Abril, no n.º 4 do artigo 2.º e no n.º 3 do artigo 4.º do Decreto-Lei n.º 219/2001, de 4 de Agosto, no n.º 7 do artigo 9.º e no n.º 3 do artigo 112.º do Código do Imposto Municipal sobre Imóveis (CIMI) e no n.º 4 do artigo 17.º do Código do Imposto Municipal sobre as Transmissões Onerosas de Imóveis (CIMT), a lista dos países, territórios e regiões com regimes de tributação privilegiada, claramente mais favoráveis, é a seguinte: 1) Andorra; 2) Anguilha; 3) Antígua e Barbuda; 4) Antilhas Holandesas; 5) Aruba; 6) Ascensão; 7) Bahamas; 8) Bahrain; 9) Barbados; 10) Belize; 11) Ilhas Bermudas; 12) Bolívia; 13) Brunei; 14) Ilhas do Canal (Alderney, Guernesey, Jersey, Great Stark, Herm...
