Lei Orgânica n.º 1/2017
de 2 de maio
Sexta alteração à Lei Orgânica n.º 1/2001, de 14 de agosto
(lei que regula a eleição dos titulares dos órgãos das autarquias locais)
A Assembleia da República decreta, nos termos da alínea c) do artigo 161.º da Constituição, a lei orgânica seguinte:
Artigo 1.º
Objeto
A presente lei simplifica e clarifica as condições de apresentação de candidaturas por grupos de cidadãos e alarga o âmbito de aplicação da Lei da Paridade, alterando a Lei Orgânica n.º 1/2001, de 14 de agosto, que regula a eleição dos titulares dos órgãos das autarquias locais, e a Lei Orgânica n.º 3/2006, de 21 de agosto (lei da paridade: estabelece que as listas para a Assembleia da República, para o Parlamento Europeu e para as autarquias locais são compostas de modo a assegurar a representação mínima de 33 % de cada um dos sexos).
Artigo 2.º
Alteração à Lei Orgânica n.º 1/2001, de 14 de agosto
Os artigos 19.º, 21.º, 23.º, 26.º e 36.º da Lei Orgânica n.º 1/2001, de 14 de agosto, alterada pelas Leis Orgânicas n.os 5-A/2001, de 26 de novembro, 3/2005, de 29 de agosto, 3/2010, de 15 de dezembro, e 1/2011, de 30 de novembro, e pela Lei n.º 72-A/2015, de 23 de julho, passam a ter a seguinte redação:
«Artigo 19.º

1 - As listas de candidatos aos órgãos das autarquias locais são propostas por um número de cidadãos eleitores correspondente a 3 % dos eleitores inscritos no respetivo recenseamento eleitoral.
2 - Os resultados da aplicação da fórmula do número anterior, contudo, são sempre corrigidos por forma a não resultar um número de cidadãos proponentes:
a) Inferior a 50 ou superior a 2000, no caso de candidaturas a órgão da freguesia ou de município com menos de 1000 eleitores; ou
b) Inferior a 250 ou superior a 4000, no caso de candidaturas a órgão dos restantes municípios.

Na apresentação das listas de candidatos, os partidos políticos são representados pelos órgãos partidários estatutariamente competentes ou por delegados por eles designados, as coligações são representadas por delegados de cada um dos partidos coligados e os grupos de cidadãos são representados pelo primeiro proponente ou pelo mandatário da candidatura.
