Dispensa gratuita de medicamentos após alta de internamento pelos serviços farmacêuticos dos hospitais que integram o SNS
A Assembleia da República decreta, nos termos da alínea c) do artigo 161. da Constituiçáo, o seguinte:
Artigo 1.
Objecto
A presente lei estabelece o regime de dispensa gratuita de medicamentos após alta de internamento, pelos serviços farmacêuticos dos hospitais que integram o Serviço Nacional de Saúde (SNS), independentemente do seu estatuto jurídico.
Artigo 2.
Dispensa de medicamentos
1 - Os hospitais que integram o SNS dispensam, através dos seus serviços farmacêuticos, os medicamentos necessários para o tratamento dos seus utentes após alta de internamento.
2 - A dispensa referida no número anterior abrange os medicamentos prescritos no momento da alta, relacionados com o tratamento da patologia que motivou o internamento.
3 - A quantidade de medicamentos dispensados deve ser suficiente para os primeiros três dias após a alta, incluindo o dia da alta, exceptuando os antibióticos que devem ser dispensados em quantidade suficiente à duraçáo da antibioterapia.
4 - Os medicamentos devem ser dispensados em quanti-dade individualizada, cumprindo as boas práticas e as normas técnicas e regulamentares aplicáveis a este tipo de distribuiçáo, incluindo a entrega ao utente, do folheto informativo.
5 - Os medicamentos sáo dispensados pelos serviços farmacêuticos no momento da alta médica.
6 - A dispensa de medicamentos, nos termos dos números anteriores, náo se aplica nos casos em que ocorra transferência para outro estabelecimento de saúde e ou unidade de internamento, incluída ou náo na Rede Nacional de Cuidados Continuados Integrados.
Artigo 3.
Encargos
1 - A dispensa dos medicamentos abrangidos pela presente lei é feita sem encargos para os utentes.
2 - Os encargos financeiros com os medicamentos abrangidos pela presente lei sáo da responsabilidade da administraçáo regional de saúde competente, salvo se a responsabilidade pelo encargo couber legal ou contratualmente a qualquer subsistema de saúde, empresa seguradora ou outra entidade pública ou privada.
