Decreto Regulamentar n.º 21/94, de 01 de Setembro de 1994
Decreto Regulamentar n.° 21/94 de 1 de Setembro Com a aprovação da Lei Orgânica da Marinha pelo Decreto-Lei n.° 49/93, de 26 de Fevereiro, foi fixada a macrostrutura deste ramo das Forças Armadas, concretizando-se, a este nível, importantes medidas reorganizativas neste ramo das Forças Armadas.
Na esteira daquele decreto-lei, importa agora definir o funcionamento de cada um dos órgãos que constituem a Marinha. Tal é o propósito do presente diploma, no que diz respeito ao Estado-Maior da Armada (EMA).
Tradicionalmente caracterizado como órgão de conselho do Chefe do Estado-Maior da Armada (CEMA), com competências no domínio do estudo, concepção, planeamento e supervisão das actividades da Marinha, ao EMA são agora conferidas responsabilidades no âmbito da função de inspecção, tanto ao nível da execução como ao nível da coordenação das actividades de inspecção.
Ao mesmo tempo, consubstancia-se a criação da Divisão de Planeamento do EMA, necessária ao planeamento integrado das actividades da Marinha.
Por outro lado, com o Decreto-Lei n.° 49/93, de 26 de Fevereiro, e a nova organização do EMA, é extinto o Conselho Técnico Naval, órgão consultivo do CEMA em matérias de natureza técnica, por se reconhecer estarem reunidas as condições para que as respectivas competências sejam exercidas por outros órgãos da estrutura da Marinha, designadamente o Conselho do Almirantado.
Cabe ainda salientar o facto de o Gabinete de Heráldica Naval, destinado ao apoio do CEMA para a concessão de símbolos heráldicos no âmbito da Marinha, passar a integrar o EMA.
Assim: Ao abrigo do disposto no n.° 1 do artigo 36.° do Decreto-Lei n.° 49/93, de 26 de Fevereiro, e nos termos da alínea c) do artigo 202.° da Constituição, o Governo decreta o seguinte: CAPÍTULOI Natureza Artigo1.° Natureza O Estado-Maior da Armada (EMA) é um órgão de apoio ao Chefe do Estado-Maior da Armada (CEMA) para o estudo, concepção, planeamento e inspecção das actividades da Marinha.
Artigo2.° Competências Ao EMA compete: a) Elaborar, por sua iniciativa ou por determinação do CEMA, estudos, informações, pareceres e propostas sobre assuntos com interesse para a Marinha; b) Traduzir as decisões do CEMA em directivas, planos, instruções ou ordens e assegurar a sua transmissão; c) Elaborar os estudos conducentes à definição da doutrina específica da Marinha, com a colaboração das entidades do ramo que for adequado consultar, nomeadamente o Instituto Superior Naval de Guerra; d) Promover o planeamento integrado das actividades da Marinha, mantendo, para o efeito, ligação com os restantes órgãos do ramo, em especial com os órgãos centrais de administração e direcção; e) Promover e assegurar a execução da inspecção dos comandos, forças, unidades e outros órgãos da Marinha; f) Promover a alteração e a divulgação da legislação com interesse para a Marinha; g) Assegurar, no âmbito das suas actividades específicas, a preparação dos elementos necessários à representação da Marinha em conferências e reuniões, nacionais e internacionais.
CAPÍTULOII Órgãos e serviços Artigo3.° Estruturaorgânica 1 - O EMA compreende: a) O Vice-Chefe do Estado-Maior da Armada (VCEMA); b) O Subchefe do Estado-Maior da Armada (SCEMA); c) As divisões; d) Os órgãos de apoio.
2 - O EMA é apoiado administrativa e financeiramente pelo conselho administrativo que for designado, nos termos da lei, pelo CEMA.
Artigo4.° Divisões 1 - As divisões estão organizadas por áreas funcionais e compreendem: a) A Divisão de Pessoal e Organização; b) A Divisão de Informações; c) A Divisão de Operações; d) A Divisão de Logística do Material; e) A Divisão de Planeamento; f) A Divisão de Comunicações.
2 - As divisões dispõem de secretarias próprias, que asseguram o expediente, o processamento e o arquivo da documentação da divisão respectiva.
Artigo5.° Órgãos de apoio 1 - Os órgãos de apoio compreendem: a) O Gabinete para a Cooperação; b) O Serviço de Cifra; c) O Serviço de Publicações; d) O Sub-Registo; e) A Biblioteca; f) O Gabinete de Heráldica Naval; g) A Secretaria Central.
