Decreto-Lei n.º 519-C/79 de 28 de Dezembro Considerando a necessidade de preservar e valorizar o património natural, cultural e arquitectónico do Parque Nacional da Peneda-Gerês, criado pelo Decreto n.º 187/71, de 8 de Maio; Considerando que, numa síntese de ética de protecção, há que promover o ordenamento do Parque Nacional da Peneda-Gerês, de forma a possibilitar a sua racional utilização, sem descurar os problemas da conservação da Natureza e do bem-estar das populações; Considerando que se impõe, com vista à prossecução daqueles objectivos, reestruturar os órgãos e serviços do Parque Nacional da Peneda-Gerês, de modo a garantir a efectivação das atribuições que lhe são cometidas; Considerando que as actuais condições de funcionamento do Parque Nacional da Peneda-Gerês e a urgência da sua estruturação e valorização não permitem de imediato encarar o problema da sua integração no Serviço Nacional de Parques, Reservas e Património Paisagístico, criado pelo Decreto-Lei n.º 550/75: O Governo decreta, nos termos da alínea a) do n.º 1 do artigo 201.º da Constituição, o seguinte: CAPÍTULO I Natureza e atribuições Artigo 1.º - 1 - O Parque Nacional da Peneda-Gerês, abreviadamente PNPG, criado pelo Decreto n.º 187/71, de 8 de Maio, é um organismo dotado de personalidade jurídica e de autonomia administrativa e financeira.
2 - O PNPG fica na dependência directa do Ministro da Agricultura e Pescas.
Art. 2.º - 1 - O PNPG abrange o território cuja delimitação consta do mapa e descrição complementar anexos ao presente diploma e está ordenado, conforme o seu plano director, em duas grandes zonas, denominadas, respectivamente, 'Pré-Parque' e 'Parque'.
2 - As alterações ao ordenamento definido no seu plano director serão aprovadas por despacho do Ministro da Agricultura e Pescas, ouvida a Secretaria de Estado do Urbanismo e Ambiente e demais.
Art. 3.º Os terrenos compreendidos no perímetro do PNPG ficam submetidos, para efeitos de exploração florestal, ao regime florestal parcial obrigatório, consoante pertençam ao Estado ou a outras entidades.
Art. 4.º - 1 - São atribuições do PNPG: a) A salvaguarda do seu património natural numa síntese de ética de protecção; b) A defesa e valorização do seu património cultural, histórico e arquitectónico; c) O desenvolvimento sócio-económico e cultural das populações nele residentes, com especial relevância nos sectores da educação e saúde: d) A compatibilização do aproveitamento dos recursos naturais com o preconizado nas alíneas a) e b); e) A promoção dos meios de interpretação do seu património e a disciplina das actividades recreativas, de forma a sensibilizar os visitantes para o respeito, uso e fruição do seu património natural e cultural.
2 - No desempenho das suas atribuições deverá o PNPG colaborar com o Serviço Nacional de Parques, Reservas e Património Paisagístico.
Art. 5.º - 1 - O PNPG tem a sede dos seus órgãos e serviços na cidade de Braga.
2 - Podem, porém, ser estabelecidos na periferia do PNPG núcleos de apoio aos residentes e visitantes.
CAPÍTULO II Órgãos e serviços SECÇÃO I Dos órgãos Art. 6.º São órgãos do PNPG: a) O director; b) O conselho geral; c) O conselho técnico; d) A comissão científica; e) O conselho administrativo.
Art. 7.º - 1 - O director do Parque é equiparado, para todos os efeitos legais, a subdirector-geral.
2 - O lugar de director do PNPG é provido em comissão de serviço, nos termos do Decreto-Lei n.º 191-F/79, de 26 de Junho.
Art. 8.º Ao director do PNPG compete, em especial: a) Presidir aos restantes órgãos do PNPG, com excepção da comissão científica; b) Representar o PNPG em juízo e fora dele; c) Praticar todos os actos que obriguem o PNPG; d) Fixar e fazer cumprir as directrizes gerais do organismo, de acordo com a orientação superiormente definida; e) Submeter à aprovação da entidade competente as propostas que de tal careçam.
Art. 9.º - 1 - O conselho geral é um órgão consultivo, constituído pelos seguintes membros: a) Um representante do conselho técnico; b) Um representante da comissão científica; c) Representantes das autarquias locais directamente interessadas nos objectivos do PNPG; d) Representantes das assembleias de compartes de baldios incluídos na área do PNPG; e) Um representante da Direcção-Geral de Ordenamento e Gestão Florestal; f) Um...
