Aviso n. 193/2008

Por ordem superior se torna público ter o Governo do Sultanato de Omá efectuado, junto do Secretário -Geral das Naçóes Unidas, em 7 de Fevereiro de 2006, a adesáo à Convençáo sobre Eliminaçáo de Todas as Formas de Discriminaçáo contra as Mulheres.

Notificaçáo

The Secretary -General of the United Nations, acting in his capacity as depositary, communicates the following:

The above action was effected on 7 February 2006, with:

Reservations

1 - All provisions of the Convention not in accordance with the provisions of the Islamic sharia and legislation in force in the Sultanate of Oman.

2 - Article 9, paragraph 2, which provides that States Parties shall grant women equal rights with men with respect to the nationality of their children.

3 - Article 15, paragraph 4, which provides that States Parties shall accord to men and women the same rights with regard to the law relating to the movement of persons and the freedom to choose their residence and domicile.

4 - Article 16, regarding the equality of men and women, and in particular subparagraphs (a) (c) and (f) (regarding adoption).

5 - The Sultanate is not bound by article 29, paragraph 1, regarding arbitration and the referral to the International Court of Justice of any dispute between two or more States which is not settled by negotiation.

The Convention will enter into force for Oman on 9 March 2006 in accordance with its article 27 (2) which reads as follows:

'For each State ratifying the present Convention or acceding to it after the deposit of the twentieth instrument of ratification or accession, the Convention shall enter into force on the thirtieth day after the date of the deposit of its own instrument of ratification or accession.'

1 - Todas as disposiçóes da Convençáo incompatíveis com a charia islâmica e com as legislaçóes em vigor no Sultanato de Omá.

2 - O parágrafo 2 do artigo 9., segundo o qual os Estados Partes concedem às mulheres direitos iguais aos dos homens no que respeita à nacionalidade dos filhos.
