Aviso n. 128/2008

Por ordem superior se torna público ter o Governo da República Portuguesa efectuado, junto do Secretário -Geral das Naçóes Unidas, em 21 de Novembro de 2005, uma objecçáo à declaraçáo formulada pelo Governo da Mauritânia no momento da adesáo ao Pacto Internacional sobre os Direitos Civis e Políticos, adoptado em Nova Iorque em 16 de Dezembro de 1966, adiante denominado o Pacto.

Notificaçáo

Portugal considers that the declaration concerning both article 18 and article 23, paragraph 4, is a reservation that seeks to limit the scope of the Covenant on a unilateral basis and that is not authorised by the Covenant.

This reservation creates doubts as to the commitment of the reserving State to the object and purpose of the Convention and, moreover, contributes to undermining the basis of international law. The Government of the Portuguese Republic, therefore, objects to the above reservation made by the Mauritanian Government to the International Covenant on Civil and Political Rights.

This objection shall not preclude the entry into force of the Covenant between Portugal and Mauritania.

Portugal considera a declaraçáo relativa ao artigo 18., assim como ao n. 4 do artigo 23., uma reserva que visa limitar o âmbito de aplicaçáo do Pacto numa base unilateral e que náo é autorizada pelo Pacto.
