Aviso n. 8/2008

Por ordem superior se torna público ter a Noruega efectuado, junto do Secretário -Geral da Organizaçáo das Naçóes Unidas, em 18 de Janeiro de 2001, uma objecçáo à reserva formulada pelo Quatar no momento da adesáo à Convençáo contra a Tortura e Outras Penas ou Tratamentos Cruéis, Desumanos ou Degradantes, adoptada pela Assembleia Geral das Naçóes Unidas em 17 de Dezembro de 1984:

It is the Government of Norway's position that paragraph a) of the reservation, due to its unlimited scope and undefined character, is contrary to the object and purpose of the Convention, and thus impermissible according to the well established treaty law. The Government of Norway therefore objects to paragraph a) of the reservation.

This objection does not preclude the entry into force in its entirety of the Convention between the Kingdom of Norway and Qatar. The Convention thus becomes operative between Norway and Qatar without Qatar benefiting from the said reservation.

Traduçáo

O Governo da Noruega é de opiniáo que a alínea a) da reserva, pelo seu carácter ilimitado e indefinido, é contrária ao objecto e ao fim da Convençáo e, por conseguinte, inadmissível à luz das normas consagradas do direito dos tratados. O Governo da Noruega opóe -se, portanto, à alínea a) da reserva.
