Aviso n. 170/2008

Por ordem superior se torna público ter o Governo da Eslovénia efectuado, junto do Secretário -Geral das Naçóes Unidas, em 19 de Janeiro de 2004, uma retirada de reserva formulada no momento da sucessáo à Convençáo sobre os Direitos da Criança.

Notificaçáo

The Secretary -General of the United Nations, acting in his capacity as depositary, communicates the following:

The above action was effected on 19 January 2004.

The reservation in question reads as follows:

The Republic of Slovenia reserves the right not to apply paragraph 1 of article 9 of the Convention since the internal legislation of the Republic of Slovenia provides for the right of competent authorities (centres for social work) to determine on separation of a child from his/her parents without a previous judicial review.

The withdrawal of reservation took effect on 19 January 2004 in accordance with article 51 (3) of the Convention which reads as follows:

'Reservations may be withdrawn at any time by notification to that effect addressed to the Secretary -General of the United Nations, who shall then inform all States.

Such notification shall take effect on the date on which it is received by the Secretary -General.'

Traduçáo

A República da Eslovénia reserva -se o direito de náo aplicar o n. 1 do artigo 9. da Convençáo na medida em que a legislaçáo interna da República da Eslovénia confere às autoridades competentes (centros de trabalho social) o direito de decidir sobre a separaçáo da criança de um ou de ambos os pais sem uma prévia revisáo judicial.
